Investigating Your Case

Our commitment to building the strongest case possible goes much further than negotiating with the insurance companies. Our experienced team of investigators will gather witness statements, conduct crash or scene-of-accident investigation and reconstruction, take necessary photographs, interview police officers, obtain and review police incident reports, and collect any other data that will create a solid foundation for your case.

The Allen & Allen team of investigators has more than 100 years of combined experience in investigations with state and local law enforcement teams. This experience ranges from motor vehicle crashes and examination of vehicle equipment to criminal investigations. The professional experience and continuous training of our investigative team provides significant value in the preparation of your case.

Your Medical Treatment

A personal injury can severely disrupt your everyday life. We know how difficult it can be to focus on anything other than your recovery, and even simple daily tasks may seem daunting.

Once you have chosen an Allen & Allen attorney to represent you, we will begin investigating your case while you continue with your prescribed medical treatment. You should continue treatment until you are fully recovered or until your doctor’s determine you have reached maximum medical recovery.

We will work to assemble a comprehensive medical history using your past medical records and current treatments so you can spend your time regaining what it most important—your health and well-being.

Once you have completed the medical treatment necessary to your recovery, your team will contact your health care providers to collect your medical and hospital records, post-incident reports, and medical bills. If you have medical expense coverage of your own, or through someone else’s auto insurance, we will help you to obtain payment for your medical bills from those sources until reimbursement and compensation are received.

Negotiating Your Case

We realize that dealing with large insurance companies can be intimidating. As your advocate, we work to shield you from that worry while keeping you informed as your case progresses.

After gathering the information and documents needed, we will present a comprehensive package to the insurance company on your behalf that takes into account your medical costs, property loss, wage loss, and any other expenses caused by the negligent party.

When we receive a settlement offer from the insurance company, we will review it carefully with you, and together we will decide what our next steps should be. Your attorney will provide you with our best professional legal advice, but of course, the final decision is up to you. Your input and participation during this step are very important.

Filing a Lawsuit

The goal of any personal injury case is to get fair and just compensation for the injured victim. If together we decide that the insurance company’s settlement offer is not fair to you, and they are not willing to further negotiate to reach amicable terms, then—with your consent—we will file a lawsuit on your behalf.

If appropriate, your attorney might recommend attempting to resolve your case through arbitration or mediation with an impartial arbitrator or mediator. In some cases, arbitration or mediation is a reasonable alternative that can be less expensive and time consuming than a trial.

If arbitration or mediation fail to achieve a satisfactory outcome, your attorney will prepare your case for trial before a jury. We understand that the idea of taking a case to trial can cause unnecessary anxiety and worry. Before and during the process, your attorney will prepare you for what to expect during each step. You will feel confident knowing that your dedicated team has built a solid, strong case to present to the jury.

If your case does go to trial, be assured that the experienced attorneys at Allen & Allen have assembled a knowledgeable and reliable team that will stand up for you and with you. Together, we are focused on a singular goal—a fair and just outcome for your personal injury.

Alternate Forms of Resolution

Filing a lawsuit does not mean your case will automatically go to trial. In fact, many cases are resolved through voluntary negotiations between the opposing parties, leading to a fair and satisfactory resolution without requiring you to enter a courtroom.

The most common ways to resolve your case without going to trial once a lawsuit has been filed are arbitration and mediation.

  • Arbitration is an out-of-court procedure for resolving disputes using one or more impartial third parties, called arbitrators, to decide your case. Learn more about arbitration.
  • Mediation is another dispute resolution method that helps opposing parties resolve their disputes without going to court. In mediation, a neutral third party, the mediator, works with the plaintiff and defendant(s) to facilitate finding a mutually satisfactory solution to your case. Learn more about mediation.

Your attorney will be your best resource in determining the most effective means of resolving your case.

Trial

Trial by jury may be the best or only option to obtain fair compensation for your injuries. At Allen & Allen, our attorneys prepare every case as if it will go to trial. Thorough trial preparation enables us to develop and present a strong and convincing case on your behalf, whether it is to insurance representatives or to a jury. We believe this is the only way to achieve our ultimate goal - a fair settlement or jury verdict. Your attorney will guide you through the trial process and ensure you are confident and prepared every step of the way.
