Our client, Jane Doe joined her then-boyfriend on an overnight hunting trip in Lovingston, Virginia where they shared a cabin with two other men who also stayed overnight.
While our client and her boyfriend were asleep in their room, the defendant, one of the other men staying in the cabin, entered their bedroom and sexually assaulted her causing our client to wake up while the assault was happening. Our client and her then-boyfriend left the cabin and went to UVA Hospital where she received a physical evidence recovery kit (PERK) that recovered the defendant’s DNA.
The defendant was criminally charged and convicted of aggravated sexual assault, but he fought the outcome at every turn. After appealing his conviction and delaying the civil trial multiple times, Attorneys Courtney Winston and Richard Armstrong were proud to stand beside our client in court and ensure her story was heard.
Attorneys Winston and Armstrong guided Jane Doe through the civil trial, clearly presenting her account and the physical evidence to the jury. When the defense argued that the DNA evidence could be explained because they were staying in the same cabin, Allen & Allen’s legal team did not back down.
After nearly two hours of deliberation the jury returned a verdict for $300,000 in our client’s favor.
