The decedent was an infant. At a residential daycare, the infant had wandered off from the main area where other children were playing. He entered a bedroom in the home, where the defendant’s boyfriend had left a gun out in the open.
The decedent played with the gun, and shot himself. The decedent leaves behind three siblings.
The defendant had no assets, but the decedent’s plaintiffs were able to recover the full insurance policy limit of $300,000. Attorney Richard Armstrong worked alongside insurance adjusters, who originally stated that the policy did not cover business insurance. Some of the settlement went toward a college fund for the decedent’s three young sisters.
The owner of the gun was prosecuted for failing to secure his weapon.
