Our client and her husband were driving northbound on US 29 in Warrenton, Virginia, when they were struck by a six-axle dump truck. This vehicle had entered their lane from the left, slamming into the driver’s side of the vehicle multiple times. The impact caused our clients to roll off into a rocky ditch.
Before falling into the ditch, our clients fought to stay on the road, but the dump truck driver appeared to be oblivious. The police were called and the dump truck driver was charged with an “unsafe lane change.” Our client suffered from a burst fracture on her vertebrae, and a disc injury that required fusion surgery. She made a good recovery.
There was a $1 million combined single limit policy that paid out the client’s property damage claim.
