In January of 2023, our client, a 61-year-old federal government worker, was injured in a motor vehicle collision. The incident took place at the intersection of Hoadly Road and Trentdale Drive in Prince William County.
Our client was in the process of making a left from Hoadley onto Trentdale when she was struck by the defendant, resulting in a T-bone collision. Contributory negligence was an issue, as the plaintiff made a left turn in front of the defendant’s vehicle. However, the defendant was traveling approximately 100 mph. This allowed the successful argument that the driver forfeited any right of way due to his excessive speed.
As a result of the high-speed crash, our client’s most significant injuries included a liver laceration, a pelvic fracture, internal bleeding, a rib fracture, a thumb laceration, a rib fracture and a full-thickness rotator cuff tear. The rotator cuff tear required surgery, which took place 6 months after the collision. Medical expenses were approximately $220,000.
The case settled for $975,000 which represented the remaining policy limits after payment of other claims from a single limits $1,000,000 policy.
