$22 Million Dollar Settlement Named Largest in 2014 by Virginia Lawyer’s Weekly

Virginia Lawyer’s Weekly has named a case handled by Allen & Allen the #1 million-dollar settlement of 2014.

Three Allen & Allen attorneys represented a young boy who was catastrophically injured after being involved in a crash with a dump truck. P. Christopher Guedri, Paul D. Hux and Jason W. Konvicka worked together to negotiate a 22 Million Dollar Settlement for the 12-year-old boy. This settlement is the largest recorded settlement in Virginia by Virginia Lawyers Weekly for a personal injury settlement involving a motor vehicle collision.

The 12-year-old plaintiff was a rear-seat passenger of a vehicle traveling in the left lane I-95 South in Sussex County. The driver of the vehicle testified that he saw the defendant’s dump truck moving slower in the right lane and then, without warning, the dump truck moved into the left lane directly in front of him, causing a collision. Evidence suggested the dump truck driver was attempting to make an illegal U-turn in an emergency vehicle crossover.

Plaintiff suffered massive internal injuries, spinal fractures that rendered him paraplegic and a moderate to severe traumatic brain injury.

Mediation was unsuccessful, but the parties continued negotiations, and the case settled several days before trial. A special needs trust was established and a portion of the settlement was structured. Monthly payments from the structure will total $66.5 million over the course of the plaintiff’s expected life.

This record setting settlement is the largest recorded personal injury settlement in Virginia involving a motor vehicle collision according to Virginia Lawyers Weekly.
