In early 2026, a Phoenix jury returned a significant verdict against Uber,\u00a0arising out of a horrific assault. The case involved a passenger who was sexually assaulted by her Uber driver\u00a0while being transported in Tempe, Arizona. The driver was\u00a0held\u00a0criminally responsible for the attack, but the civil case asked a different question:\u00a0<\/span>Can Uber itself be held legally responsible for the actions of its driver?\u00a0<\/span><\/b>\u00a0<\/span><\/p>\n

The jury\u2019s answer was yes.\u00a0<\/span><\/p>\n

The plaintiff sued<\/a> Uber under a long-standing legal doctrine known as <\/span><\/span>respondeat superior<\/span><\/span>, which allows an injured person to hold a company responsible for the wrongful conduct of its agents when that conduct occurs within the scope of the\u00a0<\/span>employment\u00a0<\/span>relationship.<\/span>\u00a0Uber\u2019s defense rested on its longstanding position that its drivers are \u201cgig workers\u201d who are not employees of Uber, but rather independent contractors. Using this familiar refrain, Uber argued that it was not responsible for the driver\u2019s actions, or any driver\u2019s actions,\u00a0<\/span>since<\/span>\u00a0companies are\u00a0<\/span>generally not<\/span>\u00a0liable for the acts of independent contractors. That statement of law is true\u00a0<\/span>to an extent, but it is far from the whole story.\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n

\u201cIndependent contractors\u201d are not automatically given a free pass<\/span><\/span>\u00a0<\/span><\/h2>\n

While it is true a person or an entity is not usually responsible for the acts of an independent contractor, it is not a hard and fast rule. Most importantly, simply categorizing a worker or agent as an independent contractor and not an employee does not in and of itself satisfy the requirements for such categorization. One main distinction between employees and independent contractors is the aspect of\u00a0<\/span>control\u00a0<\/span><\/b>over the worker.\u00a0<\/span>\u00a0<\/span><\/p>\n

The\u00a0more\u00a0control a person or entity exercises over its agent, the more likely\u00a0it is that the agent would be considered an\u00a0employee\u00a0under the law rather than an\u00a0independent contractor.\u00a0Accordingly, if a principal company, like Uber, exercises sufficient control over the manner and means\u00a0by which an agent, in this case the driver, performs contracted work, the law may treat that agent as functionally indistinguishable from an employee for purposes of liability.\u00a0This\u00a0means that a company, like Uber, cannot dodge responsibility\u00a0for the actions\u00a0of its agents by simply categorizing an agent as an \u201cindependent contractor.\u201d Rather, the relationship itself and the interactions between a company and its agents\u00a0(here, Uber and its drivers) dictate the type of relationship that exists and the legal duties that arise from it.\u00a0When it is\u00a0determined\u00a0that an agent is functionally indistinguishable from an employee\u00a0in regards to\u00a0liability, the company can be held\u00a0<\/span>vicariously\u00a0liable<\/span><\/b>\u00a0for the agent\u2019s\u00a0negligence;<\/span>\u00a0\u00a0<\/span><\/b>or, as in this case, other wrongful conduct, including sexual assault<\/a>.\u00a0<\/span>\u00a0<\/span><\/p>\n

Control was the deciding issue\u00a0<\/span><\/span>\u00a0<\/span><\/h2>\n

At trial, the jury heard evidence showing that Uber exercises significant control over its\u00a0drivers,<\/span>\u00a0\u00a0<\/span><\/b>far\u00a0beyond simply connecting\u00a0riders with independent drivers.
