en espacios reservados para personas con discapacidad"},"content":{"rendered":"<p>The holiday shopping season is upon us.\u00a0 Parking lots at the malls, shopping centers, and groceries stores are filled to capacity.\u00a0 You have circled the parking lot three times.\u00a0 Nothing is open.\u00a0 You see an available parking space, but it is reserved for persons with disabilities.\u00a0 You only need to run into the store for a few minutes.\u00a0 It\u2019s just this one time.\u00a0 You\u2019ll be right back.\u00a0 Can you park there?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-15568 aligncenter\" src=\"https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-300x211.gif\" alt=\"\" width=\"549\" height=\"386\" srcset=\"https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-300x211.gif 300w, https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-1024x722.gif 1024w, https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-768x541.gif 768w, https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-1536x1082.gif 1536w, https:\/\/www.allenandallen.com\/wp-content\/uploads\/2019\/11\/handicap-2048x1443.gif 2048w\" sizes=\"auto, (max-width: 549px) 100vw, 549px\" \/><\/p>\n<p>Unless you have and need a disabled parking license plate or placard, the answer is no.<\/p>\n<p>Why?\u00a0 Because persons with disabilities need those spaces.<\/p>\n<p>In order for an individual to obtain a disabled license plate or placard, a doctor or other medical professional must certify that the individual has a temporary or permanent disability that limits or impairs the person\u2019s ability to walk, or that creates a concern for the person\u2019s safety while walking.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 <a href=\"https:\/\/www.dmv.virginia.gov\/webdoc\/pdf\/med12.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Disabled license plates and placards<\/a> are restricted to individuals who:<\/p>\n<ul>\n<li>Cannot walk 200 feet without stopping to rest;<\/li>\n<li>Cannot walk without a brace, cane, crutch, another person, prosthetic device, wheelchair, or other assistive device;<\/li>\n<li>Suffer from severe lung disease;<\/li>\n<li>Use portable oxygen;<\/li>\n<li>Have a serious cardiac condition;<\/li>\n<li>Have an arthritic, neurological, orthopedic condition, or other debilitating condition that severely limits or impairs the ability to walk;<\/li>\n<li>Have been diagnosed with a mental or developmental amentia or delay that impairs judgment such as an autism spectrum disorder;<\/li>\n<li>Have been diagnosed with Alzheimer&#8217;s disease or another form of dementia;<\/li>\n<li>Are legally blind or deaf; or<\/li>\n<li>Have some other condition that, in the view of a licensed physician creates a safety concern while walking because of impaired judgment or other physical, developmental, or mental limitation.<\/li>\n<\/ul>\n<p>Reserved parking spaces are more than a mere convenience for people with disabilities.\u00a0 They are essential to their safety and well-being, and are necessary to protect them from further injury and harm.<\/p>\n<p>Many disabled individuals experience pain and are unsteady on their feet when they walk.\u00a0 For them, the ability to park in a space that is located closer to the front door of the building can make all the difference between being able to get out of their vehicle and go into the building, or having to give up, go home, and try another day.\u00a0 For individuals who are in a wheelchair, having the extra space that a disabled parking space provides is essential in order for them to maneuver in and out of their vehicle safely \u2013 or at all.\u00a0 Regular parking spaces simply do not have enough space for wheelchairs and other assistive devices.<\/p>\n<p>The reality is that taking a parking spot from a person with a disability, even if it is just for a few minutes, can prevent that person from being able to get in and out of their vehicle, run their errands, go to the store, or see a movie with friends or family members who have traveled from near and far to be with them.\u00a0 This is particularly devastating when one considers that for many disabled individuals, the process of getting dressed and ready to go out can be difficult, frustrating, and time-consuming.\u00a0 Simply stated, parking in a disabled parking space \u2013 even for just a few minutes \u2013 can prevent a handicapped person, and their loved ones, from having an outing that they have been planning and looking forward to for a long time.<\/p>\n<h3>What are the penalties for parking in a reserved space without authorization?<\/h3>\n<p><a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title46.2\/chapter12.1\/section46.2-1242\/\" target=\"_blank\" rel=\"noopener noreferrer\">Parking in a reserved space without authorization<\/a> can result in a parking ticket, imposition of a fine up to $500 per offense, and by having the vehicle towed from the property and impounded.\u00a0Localities are permitted to establish their own fines for unauthorized parking in reserved spaces.\u00a0 For example, violators in <a href=\"https:\/\/henrico.us\/pdfs\/countyattorney\/Chpt022TrafficandVehicles.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Henrico County<\/a>, <a href=\"https:\/\/library.municode.com\/va\/spotsylvania_county\/codes\/code_of_ordinances?nodeId=COCO_CH12MOVETR_ARTIVPA_S12-119UNPASPREPEDI\" target=\"_blank\" rel=\"noopener noreferrer\">Spotsylvania County<\/a> and <a href=\"https:\/\/library.municode.com\/va\/spotsylvania_county\/codes\/code_of_ordinances?nodeId=COCO_CH12MOVETR_ARTIVPA_S12-119UNPASPREPEDI\" target=\"_blank\" rel=\"noopener noreferrer\">Charlottesville<\/a> can be fined up to $500 per offense.Other localities that have established their own fines include the<a href=\"https:\/\/library.municode.com\/va\/richmond\/codes\/code_of_ordinances\/294021?nodeId=CH27TRVE_ARTVISTSTPA_DIV1GE_S27-200SPREPEDI\" target=\"_blank\" rel=\"noopener noreferrer\"> City of Richmond<\/a> ($200), <a href=\"https:\/\/library.municode.com\/va\/hanover_county\/codes\/code_of_ordinances?nodeId=COCO_CH15MOVETR_ARTIIIREPA_S15-42PASPREHA\" target=\"_blank\" rel=\"noopener noreferrer\">Hanover County<\/a> ($150), <a href=\"https:\/\/library.municode.com\/va\/petersburg\/codes\/code_of_ordinances?nodeId=PTIICO_CH110TRVE_ARTVIISTSTPA_DIV1GE_S110-265DUOFREPAVIISPACOETPACIPEFARECI\" target=\"_blank\" rel=\"noopener noreferrer\">Petersburg<\/a> ($150), <a href=\"https:\/\/library.municode.com\/va\/chesterfield_county\/codes\/code_of_ordinances?nodeId=PTIITHCO_CH13MOVETR_ARTIIISTSTPA_S13-41UNPAGE\" target=\"_blank\" rel=\"noopener noreferrer\">Chesterfield County<\/a> ($100), and <a href=\"https:\/\/library.municode.com\/va\/stafford_county\/codes\/code_of_ordinances?nodeId=COCO_CH15MOVETR_ARTIIIPA_DIV1GE\" target=\"_blank\" rel=\"noopener noreferrer\">Stafford County<\/a> ($100).<\/p>\n<h3>What about the striped area next to a parking space reserved for persons with disabilities?<\/h3>\n<p>The striped area adjacent to reserved parking space is called the striped access aisle.\u00a0 In 2019, the General Assembly enacted legislation that makes it <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title46.2\/chapter12.1\/section46.2-1242\/\" target=\"_blank\" rel=\"noopener noreferrer\">illegal to park in the striped access aisle<\/a>, as well.<\/p>\n<h3>What are the penalties for falsifying a disabled parking placard?<\/h3>\n<p>Falsifying a disabled parking placard can result in more serious consequences.\u00a0 It is a Class II misdemeanor that is punishable by fines up to $1,000 and up to six months in jail.<\/p>\n<p>So, if you are tempted to park in a space that is reserved for disabled persons, please don\u2019t.\u00a0 Leave those spaces for individuals who need them.\u00a0 It is the right thing to do, and it is what law
