{"id":3568,"date":"2018-03-14T10:30:00","date_gmt":"2018-03-14T10:30:00","guid":{"rendered":"https:\/\/www.allenandallen.com\/three-things-you-may-not-know-about-your-wearable-device-2\/"},"modified":"2024-08-13T08:27:02","modified_gmt":"2024-08-13T13:27:02","slug":"tres-cosas-que-puede-no-saber-acerca-de-su-dispositivo-portatil-2","status":"publish","type":"post","link":"https:\/\/www.allenandallen.com\/es\/blog\/three-things-you-may-not-know-about-your-wearable-device-2\/","title":{"rendered":"Tres formas en que su reloj inteligente puede afectar su caso legal"},"content":{"rendered":"<p>You&#8217;ve probably noticed that the market for wearable technology like fitness trackers and smart watches is on the rise, but did\u00a0you know that the data they collect is admissable in court?<a title=\"\" href=\"#ftn1\">[1]<\/a><\/p>\n<p>Fitbit is a company that makes wearable devices which gather information about your health as your wear them; they track statistics such as steps, heart rate, and will even monitor your sleep.<a title=\"\" href=\"#ftn2\">[2]<\/a> In 2014, Fitbit had approximately 6.7 million paid\/active users and sold 10.9 million devices.<a title=\"\" href=\"#ftn3\">[3]<\/a> While the health benefits for these devices are numerous, a few precautions must be shared when it comes to your personal injury case.<\/p>\n<h2>1. Wearables May Be Used to Aid Your Damages Claim<\/h2>\n<p>A young woman who was injured in Canada last year was the first person to use a wearable device to help strengthen her case.<a title=\"\" href=\"#ftn4\">[4]<\/a> The plaintiff was a personal trainer who was injured.<a title=\"\" href=\"#ftn5\">[5]<\/a> As part of her case, she had to prove the issue of damages (<em>i.e.<\/em>, that her life was different as a result of her injury).<a title=\"\" href=\"#ftn6\">[6]<\/a> In lieu of having her examined by the defense\u2019s medical expert, she was requested to wear a Fitbit to track her physical health and movement.<a title=\"\" href=\"#ftn7\">[7]<\/a> This data was used to aid the jury in calculating how much her injury had impacted her life.<a title=\"\" href=\"#ftn8\">[8]<\/a><\/p>\n<h2>2. Wearables Can Be Used to Impeach Testimony<\/h2>\n<p>In Pennsylvania, the opposite situation occurred. Data from a Fitbit was used to <em>disprove<\/em> a witness\u2019 version of events.<a title=\"\" href=\"#ftn9\">[9]<\/a> A woman called the police to report a crime.<a title=\"\" href=\"#ftn10\">[10]<\/a> She told the police she was attacked while she was sleeping.<a title=\"\" href=\"#ftn11\">[11]<\/a> She voluntarily provided the username and password information for her Fitbit, which police found in the hallway after she claimed it was lost in the scuffle.<a title=\"\" href=\"#ftn12\">[12]<\/a> The data from the device showed the woman was never asleep that night, but rather up and walking around the whole time in direct contradiction of her testimony.<a title=\"\" href=\"#ftn13\">[13]<\/a><\/p>\n<h2>3. They Can Be Considered a Digital &#8220;Expert Witness&#8221;<\/h2>\n<p>If there is a dispute over how badly you are harmed in a personal injury case, there will generally be a \u201cbattle of experts.\u201d The defense might hire an expert doctor to examine you and provide a conclusion to how limited your injury is in order to rebut the testimony of your own doctor. But with wearable devices at play, it won\u2019t necessarily be a doctor that testifies against your injury. For users of devices such as Fitbit and Jawbone, it could be a collection of your profile data compared to your own personal data.<a title=\"\" href=\"#ftn14\">[14]<\/a> Injuries in the future may be calculated based on whether or not the data points on your wearable device fall above or below the median for all other wearable users.<\/p>\n<p>None of this is meant to dissuade the use of wearables.
