The anonymous nature of the internet often makes it easier for people to harass or intimidate others through the use of violent or obscene language. Many who would shy away from a confrontation in person are willing to speak harshly or cruelly from the safety of their keyboard.<\/p>\n<p><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/sedugwFSzrI\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/p>\n<p>A 2017 <a href=\"https:\/\/www.pewresearch.org\/internet\/2017\/07\/11\/online-harassment-2017\/\" target=\"_blank\" rel=\"noopener noreferrer\">Pew Research Center Study<\/a> found that 41% of American adults have experienced online harassment, and 10% of Americans have received physical threats online.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> These types of threats and harassment, even if sent over the internet, are illegal in Virginia, and there may be penalties involved.<\/p>\n<p>\u201cAny person who uses obscene, vulgar, profane, lewd, lascivious, or indecent language, or makes any suggestion or proposal of an obscene nature, or threatens an illegal or immoral act with the intent to coerce, intimidate, or harass any person, over any telephone or citizens band radio, in this Commonwealth, is guilty of a Class 1 misdemeanor.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>\u00a0 While the text of this statue only says \u201ctelephone or CB Radio,\u201d as of July 2011, the statute expanded the definition of \u201ctelephone\u201d to include \u201cany electronically transmitted communication producing a visual or electronic message that is received or transmitted by cellular telephone or other wireless communications device.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>Class 1 misdemeanors are punishable by up to one year in jail and a fine of up to $2,500 \u2013 or both.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>The words in question don\u2019t necessarily have to be \u201cobscene.\u201d The statute also prohibits threats and illegal or immoral acts.\u00a0 Under the statute, a threat can be any statement a reasonable recipient would interpret as a threat.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>\u00a0 Any potential obscenity will also be considered in the context of the relationship between the individuals involved, and the person making the statements must also intend to coerce, intimidate, or harass the recipient.
