The Distracted Driving Epidemic

Author: P. Christopher Guedri, Richmond Personal Injury Attorney

Distracted driving occurs when a driver's primary attention is taken away from the essential task of driving a motor vehicle. This common behavior endangers the life of the driver as well as other drivers, passengers and pedestrians.  Unfortunately, distracted driving has risen to epidemic levels on our highways all across the country.   Thousands of car accidentsoccur each year due to this extremely dangerous manner of driving.

Drivers should be focused on the road and be prepared to respond in a split second to unforeseen circumstances that might suddenly arise. When a driver becomes distracted, at least one of these three things…

'Castle Doctrine' Bills Shot Down in Virginia's General Assembly

Author: David M. Williams, Jr., Fredericksburg Personal Injury Attorney

Two bills giving Virginians the green light to use deadly force against intruders into their homes died in the 2012 General Assembly session.

The "Castle doctrine" originated from old English common law rules protecting a person's home and the principle underlying the phrase "a person's home is their castle". The doctrine allows the use of physical force, including deadly force, by a person in his/her home against an intruder who has committed an overt act against him/her or against someone else lawfully in the home. Many states have laws that are based on the Castle Doctrine.[1] One of the Virginia bills would have protected…

Motor Vehicle Safety: Passenger Van Safety

Author: Jason W. Konvicka, Richmond Personal Injury Attorney

Passenger vans are commonly used by colleges, churches, camps, and other groups during the active summer months. The National Highway Traffic Safety Agency ("NHTSA") recently urged the users of 15-passenger vans to take specific steps to keep drivers and passengers safe.[1]These vehicles have special dangers if not operated properly.

Passenger vans handle very differently from smaller passenger vehicles because they are typically longer, higher, wider, and heavier (especially when loaded).  They require trained drivers who are comfortable and experienced  with the unique driving characteristics of larger vehicles. National Phone Survey on Distracted Driving Attitudes and Behaviors

Author: P. Christopher Guedri

Distracted drivers cause car accidents.  Every day, on our roads and highways, distracted drivers cause collisions that seriously injure and kill innocent people.[1] Many times these are friends or family members who are in the vehicle with them.

When a driver takes his or her focus away from the primary task of driving, the risk of being involved in a car crash immediately increases. What are people really doing while they are driving? Why do drivers get so distracted? The National Highway Traffic Safety Administration (NHTSA) conducted a recent survey (11/2010 - 12/2010) to look at distracted driving behaviors and attitudes of drivers over the age of 18. Trial Practice: Arguing Amounts for Specific Items of Damages: The Virginia Supreme Court's Decision in WAKOLE v. BARBER

On March 2, 2012, the Virginia Supreme Court issued a very important decision addressing whether, in a personal injury case, a plaintiff or their attorney  may argue, in closing argument, specific dollar amounts for each element of damages listed in Virginia Model Jury Instruction No. 9.000.  A Virginia statute allowed a plaintiff or their attorney to tell a jury a specific amount that the plaintiff wanted for a total verdict.  Certain elements of the damages already have an amount -- for instance, the amount of the medical bills and the amount of the lost earnings - and a plaintiff was allowed to ask for those.  However, other items of damages do not -- for example, physical pain, emotional suffering, inconvenience, etc. - and…

Immigration Status and the Right to Sue for Personal Injury

As a Spanish-speaking personal injury attorney, I have had the privilege of representing many immigrants in personal injury cases.   Regardless of immigration status, immigrants have the right to sue for injuries caused by the negligence of others, and have the right to claim earnings lost as a result of their injuries.
