Why You Should Hire a Personal Injury Attorney - VIDEO

David M. Irvine, Charlottesville, VA Personal Injury Attorney

Author: David M. Irvine, Charlottesville, VA Personal Injury Attorney

A driver who has been injured through no fault of his or her own in an automobile collision often will be contacted by the insurance company for the at-fault party very soon after the accident occurs. The insurance adjuster will gather information about the individual’s injuries, and may make a settlement offer to quickly resolve the case.  I have found that some injured people question why they need a personal injury lawyer to represent them with their claim when they have already established a relationship with the adjuster, may already have received an offer of compensation, and feel that they can simply deal with the insurance company…

Five Things That Affect How Long Your Personal Injury Case Takes

Ryan E. Wind, Mechanicsville, VA Personal Injury Attorney

Author: Ryan E. Wind, Mechanicsville, VA Personal Injury Attorney

My clients frequently ask me how long it will take to settle a personal injury case. While there is no straightforward or simple answer, there are five main factors that significantly affect how long it takes to resolve a claim.

Severity of Injuries/Length of Treatment

If you are injured in an accident due to someone else’s negligence, we encourage you to contact an attorney as soon as possible. Some insurance companies are unwilling to discuss resolving your claim until you have fully recovered or reached maximum medical improvement. If the insurance company is unwilling to discuss your case until the full…

Why We Call Richmond Home

Courtney Allen Van Winkle, Richmond, VA Personal Injury Attorney

Author: Courtney Allen Van Winkle, Richmond, VA Personal Injury Attorney

In 1910, my grandfather, George E. Allen began a one man law firm in Lunenberg County, Virginia. Over twenty years later, in 1931, he moved his practice and his family to Richmond, where the firm would grow to become the largest personal injury firm in Virginia. In 2011, more than 100 years after George Allen began his  law firm, Scott Fitzgerald, a 4th generation Allen joined  the Allen Law Firm with a commitment to carry on the legacy of excellence.

We are proud to call Richmond our home, a city filled with rich culture and compelling history.  Our location in the center of Virginia’s capital city is no coincidence. Since…

The attorneys at the Allen Law Firm provide free initial consultations to help people know their rights and make a decision on whether to hire an attorney or handle the matter on their own. Our contingency fee agreements allow the injured party to seek justice without having to pay an attorney on an hourly basis. This allows more injured persons to obtain the justice they deserve. The Virginia Supreme Court set up the Access to Justice Commission, hoping to give more people access to the civil justice system. The Commission created a website, http://selfhelp.vacourts.gov/, to answer commonly asked questions by people who are trying to defend…

What You Need to Know about Dash Cams in Virginia

R. Christopher Jones, Richmond, VA Personal Injury Attorney

Author: R. Christopher Jones, Richmond, VA Personal Injury Attorney

Dashboard cameras, also known as ‘dash cams,’ are small devices that are mounted on cars and record what is happening in and around the vehicle. Though they are commonly mounted on a car’s dashboard, they can also be attached to the windshield or elsewhere.[1] The cameras can be programmed to begin recording as soon as the driver turns on the car, and they record everything onto a memory device that can be reviewed after each drive.[2]

Why use a dash cam?

Dash cams are useful due to what they capture. Because dash cams record everything from the driver’s perspective, they can be used to show a series of events in the order that…

Fried Turkey for Thanksgiving: Tips to Keep You Safe

Danielle M. Bringard, Fredericksburg, VA Personal Injury Lawyer

Author: Danielle M. Bringard, Fredericksburg, VA Personal Injury Lawyer

The United States Consumer Protection Safety Commission (CPSC) reported that since 2002, there have been more than 157 turkey fryer-related incidents. These include fires, burns, and explosions or carbon dioxide poisoning.[1] Among the 68 listed injuries, none have been fatal;[2] however, this should not take away from how dangerous conventional turkey fryers can be.

In 2007, a seven year old was badly burned when he stepped on a rubber hose connecting a turkey fryer to a propane tank, causing the pot to fall over and heated oil to pour onto his back.[3] In another incident, a mother and her teenage daughter were injured…

The Personal Injury Recipe: Damages (Part 2 of 3)

Christopher J. Toepp, Fredericksburg, VA, Personal Injury Attorney

Author: Christopher J. Toepp, Fredericksburg, VA, Personal Injury Attorney

At the outset of each lawsuit, I tell all my clients that, in the broadest sense, every Virginia personal injury claim consists of three components: liability, damages and insurance coverage. These are the ingredients necessary for success in the personal injury process.  As my initial meeting unfolds, I go into more detail about the individual considerations that are contained within each of these three broad categories. If the facts and circumstances are deficient in any one of the three, there may be a major obstacle in the path to obtaining full and fair financial recovery. This article follows The Personal Injury Recipe: Liability…
